These Terms and Conditions apply to www.jbm.ca and the JBM Office Systems Ltd. online store at shopjbm.ca. Please read them carefully before using the Website or placing an order.
By accessing or using www.jbm.ca (the “Website”), our online store (the “Store”), or by placing an order or requesting a quote through either of them, you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree, please do not use the Website or the Store.
If you are using the Website or the Store on behalf of a business, you confirm that you are authorized to bind that business to these Terms.
The Website and the Store are operated by JBM Office Systems Ltd. (“JBM”, “we”, “us” or “our”), a locally owned and operated business serving Niagara and the surrounding region. JBM Office Systems Ltd. was incorporated on January 23, 1987.

You agree to use the Website and the Store only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Website. You must not:
We may suspend or restrict access to the Website or the Store at any time, including for maintenance, security or suspected misuse.
Guest checkout is available for all orders. Exclusive pricing is only available with an account. Some features, such as saved information, order history and approved business account terms, require you to create an account.
You are responsible for keeping your login details confidential and for all activity under your account. Please notify us promptly if you believe your account has been used without your permission. You agree to provide accurate and current information and to keep it up to date. We may suspend or close an account that is inactive, inaccurate or used in breach of these Terms.
The Store sells office technology products and supplies, including printer and copier supplies, printers and multifunction products, mailing solutions, and scanners and shredders. Quotes may be requested for products and services that are not priced online.
All prices are shown in Canadian dollars (CAD) and, unless stated otherwise, do not include applicable taxes, including Ontario HST. Taxes are calculated and shown at checkout.
We make reasonable efforts to keep product descriptions, images, specifications, prices and stock information accurate. Errors can occur. We may correct any error, change prices or product information, or limit quantities at any time, including after you place an order. If a price error affects your order, we will contact you and give you the option to confirm the order at the corrected price or cancel it without charge.
Product availability is not guaranteed. Images are for illustration only and the product you receive may differ slightly in packaging or appearance from the image shown.
Placing an order is an offer to buy. We will email an order confirmation, but that email is not our acceptance of your order. We accept your order when we ship it or when we tell you that we have accepted it.
We may refuse or cancel any order, or limit quantities, for reasons including product unavailability, pricing or product-information errors, suspected fraud, failed payment authorization or credit checks. If we cancel an order after payment, we will refund the amount charged.
Quotes are valid for the period stated on the quote. If no period is stated, a quote is valid for 30 days. Quotes are not a guarantee of availability.
Credit card payments at checkout are processed securely by a third-party payment processor, Paya. We accept Visa and Mastercard. JBM does not store card numbers on its own network. Card details saved for your account, if any, are held in encrypted form by the payment processor. Your card is authorized when you place your order, and by providing payment details you confirm you are authorized to use that card.
JBM does not charge a credit card processing fee on orders placed through the Store.
Approved business accounts: customers who have been approved by JBM for business account terms may order on account and pay by invoice. Payment terms are as stated on the invoice or in your account agreement, currently net 30 days. Account approval is at our discretion and may be changed or withdrawn. Overdue balances are subject to interest at 2% per month (24% per year). We may require payment in advance for any order.
You are responsible for any applicable taxes and duties. If a payment is declined or reversed, we may cancel or hold your order.
From time to time we may offer promotions or discount codes. Unless the offer says otherwise:
JBM can ship anywhere in Canada, but our primary market is Ontario. Shipping charges are calculated at checkout based on the items, their weight and your delivery address, using carrier rates (for example UPS).
Pickup: pickup is available at 19 Hiscott Street, St. Catharines, Monday to Friday, 8:30 am to 5:00pm, at no fee.
Installation: professional installation is available on hardware purchases, with customized fees based on consultation with our sales representatives.
Estimated delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, weather, customs or other events outside our control. Risk of loss passes to you when the order is delivered to the address you gave us. Please check your delivery on arrival and notify us within 3 business days if anything is missing or incorrect, and keep all packaging. Damaged items must be noted to the carrier upon receipt.
Some larger equipment, such as copiers, mailing systems and shredders, may require separately arranged delivery and installation, which we will quote to you.
We want you to be satisfied with your purchase. If you need to return an item, please contact us before sending anything back so we can give you return instructions.
Returns are accepted within 10 business days of the date of proof of delivery for unopened items, and a restocking fee of 20% applies to eligible change-of-mind returns. The restocking fee is waived when the error is ours. To be eligible, items must generally be unused, in their original, unopened packaging and in resalable condition, with proof of purchase.
The following items cannot be returned: special-order or non-stocked items; opened toners, inks, cartridges and drums; custom or configured equipment; software; and installed or programmed items.
If an item arrives damaged or defective, or we ship the wrong item, contact us promptly and we will arrange a replacement, exchange or refund at our discretion, at no cost to you for the return shipping. For change-of-mind returns, the customer pays the return shipping.
Approved refunds are issued to the original method of payment, or as a credit on account for account customers, within 5 to 10 business days after we receive and inspect the return. Card refunds go back through Paya. Original shipping charges are generally non-refundable unless the return is due to our error.
Products sold by JBM are covered by the manufacturer’s warranty, if any, that comes with the product. Warranty terms, length and coverage are set by the manufacturer and vary by product. Warranty claims are handled under the manufacturer’s policy, and we will help you with the process where we can. Repair and service work performed by JBM is covered by the terms in your service agreement or work order.
Except for the manufacturer’s warranty and any rights you have that cannot be excluded under applicable law, the Website, the Store and all products are provided “as is” and “as available”, and we make no other warranties, express or implied, to the extent permitted by law. Nothing in these Terms limits any statutory consumer rights that cannot be limited by contract.
To the fullest extent permitted by law, JBM, its owners, employees and suppliers will not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, revenue, data or business, arising from your use of the Website or the Store, or from any product purchased through them, even if we have been told such damages are possible.
To the extent permitted by law, our total liability to you for any claim arising from an order will not exceed the amount you paid for the product or service that is the subject of the claim.
We do not guarantee that the Website or the Store will always be available, secure or free of errors. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Ontario or Canadian law
The content of the Website and the Store, including text, graphics, logos and layout, belongs to JBM or its licensors and is protected by copyright and trademark laws. You may view and print pages for your own personal or internal business use, but you may not copy, modify, distribute or reuse the content for other purposes without our written permission.
Brother, Ricoh, Quadient, Epson, Toshiba, HP, Lexmark, OKI and all other brand names, product names and logos shown on the Website or in the Store are the trademarks of their respective owners. They are used for identification only, and their use does not mean that the owner endorses JBM or the Website, except where JBM is an authorized dealer or partner.
JBM is an authorized dealer of Brother, Ricoh, Quadient, Epson, Toshiba and Lexmark.
The Website and the Store may contain links to third-party websites and services, including payment, carrier and manufacturer sites. These are provided for convenience only. We do not control and are not responsible for the content, policies or practices of any third-party site, and a link does not mean we endorse it. Your use of those sites is at your own risk and subject to their terms.
Your use of the Website and the Store is also governed by our Privacy Policy, which applies to both www.jbm.ca and shopjbm.ca and explains how we collect, use and protect personal information: https://www.jbm.ca/privacy-policy.
These Terms and any dispute arising from them or from your use of the Website or the Store are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario, without regard to conflict-of-laws rules. You agree that the courts of Ontario, sitting in St. Catharines, Ontario, Canada, have jurisdiction over any such dispute, except where applicable law gives you the right to bring a claim elsewhere.
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date, and it applies to your use of the Website and the Store from that date. Orders you placed before the change are governed by the Terms in effect when you placed them. Please review the Terms regularly. Continued use after a change means you accept the updated Terms.
